Negligence Mass Tort Litigation October 2026 Update: What Changed, Why It Matters, and What to Watch Next

Negligence mass tort litigation in October 2026 changed on trial results and settlements, not new filings. A $40 million PowerPort verdict, a Depo-Provera master settlement and J&J's return to court defense shifted leverage for claimants, while hair-relaxer, AFFF and two new drug-device MDLs set the next tests. Mass tort litigation means many individual injury lawsuits over the same product grouped for pretrial work in federal court, with each person keeping a separate claim.

The field remains highly concentrated. The Judicial Panel on Multidistrict Litigation reported about 206,000 pending MDL actions on Sept. 1, 2026, with 194,835 cases in 21 MDLs of 1,000 or more cases, in the September pending-dockets report. That concentration means a few bellwethers and settlement programs affect most pending claims.

How concentrated is the October docket?

Federal mass torts are dominated by very large dockets. About 94.5% of pending MDL cases sit in only 21 proceedings. Movement in one large MDL can therefore affect settlement timing across the system.

For readers, size does not mean speed. Large MDLs use bellwether trials, expert fights and registration programs to sort claims. Small new MDLs move faster at first, then face the same expert and causation tests.

What did the PowerPort verdicts change?

The Bard PowerPort cases test claims that the implanted port catheter can fracture, migrate and cause serious injury. A federal jury in Arizona awarded Kimberly Divelbliss $40 million on Sept. 4, 2026, finding Bard and Becton Dickinson liable for defective design and failure to warn after a fracture reached her heart, as announced by plaintiffs' counsel Ciresi Conlin in the PR Newswire announcement. The result splits the early bellwethers. Doyle APC reports the first bellwether, the Cook infection case, ended in May 2026 with a defense verdict on warning claims and a hung jury on design defect.

The next fracture-case trial was set for Oct. 13, 2026. The split matters for valuation. One defense verdict did not end the litigation, and one large plaintiff verdict does not set payment for others. Lawyers on both sides will watch whether fracture and migration claims fare differently than infection claims.

Where do talc and Depo-Provera stand?

Johnson & Johnson's third talc bankruptcy route failed. Chemistry World reports the bankruptcy court denied settlement through subsidiary Red River Talc, and J&J said it will not appeal. The company will now defend tens of thousands of ovarian cancer and mesothelioma claims in litigation. Depo-Provera moved the other way, toward resolution. Pfizer and plaintiffs' leadership signed a Master Settlement Agreement on July 21, 2026 covering more than 6,400 meningioma cases in MDL 3140, according to LawFold in the September Depo-Provera update. The deal vacated the Dec.

7, 2026 Toney v. Pfizer bellwether trial. Settlement does not mean automatic payment. Registration was due Nov. 30, 2026 under the reported program terms. Claimants need proof of use, diagnosis, medical records and compliance with program deadlines.

What should hair-relaxer and AFFF claimants watch?

Hair-relaxer litigation in MDL 3060 before Judge Mary Rowland had 12,129 pending federal cases on Sept. 1, 2026, with no verdict or settlement, as reported by TortAdvisor in the September hair-relaxer update. Expert discovery was set to close Oct. 16, 2026, with Daubert and summary-judgment motions due Nov.

16, 2026. AFFF and PFAS personal-injury cases in MDL 2873 before Judge Gergel had about 15,264 cases pending in September 2026, according to LawyersTrend. The October 2025 bellwether was vacated under Case Management Order 35, with no replacement date set and a 28-case cancer and injury pool in discovery. These dates decide which science reaches a jury:.

  • hair-relaxer: expert reports and challenges through November test links between use and uterine, endometrial, ovarian and related injuries
  • AFFF: discovery in the smaller injury pool will shape which cancers and exposures go first
  • both MDLs: missed medical-record, plaintiff-fact-sheet and expert deadlines can weaken an individual claim even when the MDL continues

Which new negligence MDLs are just starting?

Dupixent MDL 3180 was centralized June 4, 2026 over claims linking the drug to cutaneous T-cell lymphoma. Atumio News reports the court set an initial conference for Oct. 1, 2026. Early orders will cover leadership, records, science and scheduling. The spinal-stimulator MDL 3181 was created June 5, 2026 with 29 cases.

The Judicial Panel on Multidistrict Litigation listed Sept. 24, 2026 arguments on consolidation issues involving Abbott and Nevro devices. Device cases often turn on warnings, implant technique, follow-up care and product-specific failure proof. New MDLs offer less prediction. There are no bellwether verdicts, no class-wide settlement and limited rulings on expert proof. Save pharmacy, implant, explant, imaging and pathology records now and follow initial conference orders.
