After the September 24 JPML Hearing: How to Verify a Lawsuit Consolidation Order

After the September 24 JPML hearing, verify consolidation by locating a signed JPML transfer order for the MDL. A hearing, argument, or news report does not create an MDL by itself. MDL means multidistrict litigation, a procedure that moves related federal lawsuits to one judge for pretrial work.

The September session addressed spinal cord stimulator cases against Abbott and Nevro. Only a Panel order creates MDL No. 3194 or MDL No. 3195.

What was on the September 24 agenda

The Judicial Panel on Multidistrict Litigation convened its September 2026 hearing session on Thursday, September 24, 2026, in Chicago, Illinois, at Northwestern University Pritzker School of Law, according to the JPML Hearing Information page. The date and location fix which session record controls later verification. The Lawsuit Information Center September 29 update reports the session heard oral argument on separate manufacturer-specific MDLs for spinal cord stimulator cases, according to its September 29 update.

Abbott cases were docketed as MDL No. 3194 and Nevro cases as MDL No. 3195. The same update reports the Panel had not yet posted an order deciding either motion.

Where is the order posted?

To verify consolidation, check the JPML Hearing Information page and its news posts titled Orders from a hearing session. The Judicial Panel on Multidistrict Litigation publishes filed transfer or denial orders there after each session, as shown by its Orders from September 28, 2023 session post.

Look for the September 24, 2026 session entry first. If neither MDL number appears in a filed order, no consolidation has occurred. Recheck the same JPML pages because orders from a session are posted together after decision.

  • Open the Hearing Information page and find the September 24, 2026 session.
  • Open the linked Orders post and search for MDL No. 3194 and MDL No. 3195.
  • Open any matching order and confirm signatures, MDL number, and transferee court.

What does a real transfer order show?

The controlling proof is a signed JPML Transfer Order naming the MDL number, transferee district, and judge. AboutLawsuits reported one June 5, 2026 example centralizing Boston Scientific stimulator cases as MDL No. 3181 in the Central District of California, according to its June 2026 report. Use that format as the test for Abbott and Nevro claims.

A transfer order also lists the included cases and the reasons for centralization. A denial order uses similar captioning but refuses transfer. Oral argument alone does not guarantee an MDL, under 28 U.S.C. section 1407 procedure described by the University of Chicago Legal Forum.

Which cases move and what to watch next

Who is affected is defined by the Schedule of Actions attached to the motion and order. AboutLawsuits' August hearing notice reports the Abbott petition listed 15 lawsuits across seven federal districts. Only qualifying federal cases on that schedule transfer, not every injury report or state filing.

Consolidation covers only pretrial proceedings, with cases keeping separate identities and returning for trial. If either MDL is granted, later matching federal cases follow through conditional or tag-along transfer orders. Recheck the JPML docket by MDL number and the transferee court docket before assuming inclusion.
